Onedate (web and mobile application) and its services are part of TKD WHITE LABEL NETWORK (henceforward "TKD NETWORK"), published by the company SKIB SAGL. Onedate operates using the entire database on the network or only parts of it. By registering or subscribing the user will become part of TKD NETWORK.
ONEDATE members commit themselves to abide by the following Terms and Conditions. In case those conditions are not accepted, the user cannot become a ONEDATE member. In order to sign up for one or more ONEDATE services and use this site, it is assumed that the member has fully accepted these conditions. By ticking the "Sign Up" button, on the sign-up popup, the Member declares to be fully informed and is considered to be bound by all the provisions of these Terms and Conditions.
The following words or expressions in these Terms and Conditions, bear the following meanings.
ONEDATE:
Multi-access Dating-service with a fee, released by SKIB SAGL company. Some of ONEDATE services are free of charge whereas other functionalities require a fee.
TKD NETWORK: a complex of dating sites with full and partly shared database, published by SKIB SAGL company;
Membership:
Method of payment to enjoy the services provided by ONEDATE.
Fees:
Contract types, stipulated to enjoy the ONEDATE services, depending on weekly, monthly, quarterly or annual modalities. Furthermore, are foreseen also special service packages and offers.
Member:
The user has properly signed up for ONEDATE services, independently of a subscription fee.
In order to register to this website, it is necessary to accept the Terms of Use related to the services provided by Onedate.
All the costs related to the equipments and their use (computer, apps, telecommunication means, etc.), which give access to the Services, are entirely at the expense of the Subscriber.
In order to become a ONEDATE Member and thus of TKD NETWORK, it is necessary to be at least 18 years old and fill out all the mandatory fields in the sign-up form. The Member guarantees that the information provided is accurate and corresponds to the truth. The Member shall immediately inform ONEDATE about any change related to the information provided during the sign-up process or, if it is needed, shall make the necessary changes in the personal area under the section "My profile", on ONEDATE site. If the mandatory conditions for signing-up are met, every Member can choose a nickname and set a password for each profile on which a username has been activated.
Users may create and manage more than one personal profile, but they will have to buy a subscription for each profile with which they want to operate at the ONEDATE platform. Usernames and passwords are strictly personal and confidential and must not be divulged or disclosed to third parties. ONEDATE cannot be held liable under any circumstance for the loss of username and/or password by the Member. Should a Member forget his/her password, he/she can file a request to ONEDATE by simply entering his/her nickname at the appropriate form and submitting it. ONEDATE shall send an email to the address provided by the Member containing the password corresponding to the nickname.
Should a Member divulge or use his/her access credentials against their purpose, ONEDATE reserves the right to close this Member's account without any notice. However, Members have the right to change or edit their password as they wish. ONEDATE's records will only keep the last password entered and those used in the past will be replaced with the newest one. Members must confirm the accuracy of the email address provided during the sign-up process by replying to a confirmation email sent by ONEDATE staff. Should a Member fail to reply to the confirmation e-mail in a fortnight after signing up, he/she cannot access to all the services and ONEDATE reserves the right to delete his/her profile. The Member is the sole responsible for the use of his/her credentials by third parties or actions or declarations done using their personal account, whether they are fraudulent or not. Thus, the Member binds himself/herself to keep ONEDATE unharmed from and to indemnify ONEDATE for any third-party claims.
ONEDATE does not have the means to guarantee the identity of the persons who sign up for its Services, therefore, it is not liable in case the identity of a Member is abused. If a Member has grounds to believe that third parties are using his/her access credentials or his/her account, he/she must inform ONEDATE about it immediately. If a Member wants to introduce a friend and provides ONEDATE with his/her personal information, the Member is obliged to obtain an explicit consent from that friend in advance so that ONEDATE can process his/her personal information, which will be used exclusively to send him/her an electronic message to inform him/her of ONEDATE and its Services in the name and on behalf of the Member who provided ONEDATE with his/her personal information. The Member is also responsible for that friend before ONEDATE and third parties, as well as for the consequences arising from the transmission of his/her personal information to ONEDATE. Access credentials of Members who have not been using the service may be deleted 6 months after the last valid access to ONEDATE site. Furthermore, ONEDATE reserves the right to deactivate the profiles of Members, who have not replied to the confirmation e-mail sent to the e-mail address that they entered on the registration form, after the first step of the sign-up process, within a period of fifteen days, starting from the date the sign-up confirmation email is sent by ONEDATE system. ONEDATE reserves the right to delete Member's messages 6 months after their sent date.
After Members sign up for the service and pay the subscription fee of their choice, they can access services available at ONEDATE. Members can access the prices and payment methods for the services available at a later moment, while viewing and using the services that they want to sign up for, as well as while viewing and using the corresponding fees. While using the service, the Member commits himself/herself to abide by the following rules in particular:
Comply with the law and the rights of others.
Do NOT use ONEDATE for professional, commercial or non private purposes (client search, etc) or for illicit, illegal, immoral, indecent scopes or against public order.
Publish, disseminate, or broadcast information or content of any kind which corresponds to the truth.
Do not declare, use expressions or divulgate content in any form that violates third-party rights or any slanderous, abusive, obscene, pornographic, pedopornographic, offensive, violent or inciting violence, political, racist or xenophobic content and, in general, any content not compliant with the subject matter of ONEDATE, laws in vigor, public order, personal rights, morals and protection of minors. In particular, photographs, videos and any other information, data or file supplied by a Member to ONEDATE must be decorous and refer to the Member exclusively or, in case they regard a third party, they must include their explicit authorization under the exclusive responsibility of the Member concerned.
Do not communicate any personal information (electronic address, mail address, telephone number, etc) at ONEDATE site that might allow a Member to contact another Member without having to use ONEDATE.
Do not publish, disclose or broadcast information or content in any form that could diminish, disorganize or prevent the regular use of the Services, interrupt and/or slow down the regular transmission of the messages between Members by means of the Services, such as applications, viruses, Trojan horses, sending mass messages (spam), etc. ONEDATE reserves the right to eliminate messages sent by a Member in bulk in order to make sure that other Members can use the services at a proper quality level.
Do not publish, disclose or broadcast information or content in any form, which contains advertisement of any kind or links to other websites.
Subject to the provisions of article "Termination of the contract", in case of violation by a member of one or more of these rules, ONEDATE reserves the right to block the account of the Member concerned, automatically delete messages or controversial content, regardless of their nature, to prevent the publication of the member's profile, in whole or in part, and/or to block its access to services, in whole or in part, either temporarily or permanently, without compensation or reimbursement and without prejudice to any claims against the Member concerned. ONEDATE cannot be held liable for false statements made by a member. Therefore we recommend that members take precautions when meeting other members. ONEDATE assumes no liability for meetings between ONEDATE Members, on ONEDATE or during meetings between members and non-members following the use of ONEDATE site and related services.
To that matter, ONEDATE reminds its Members that they cannot disclose or divulgate information to other ONEDATE Members at ONEDATE site which can be used to identify them, such as their last name, mail or email address and telephone number. Furthermore, should you want to meet another user whom you have met at ONEDATE, we recommend you to inform a friendly person and give preference to public places (cafés, restaurants, etc).
In order to safeguard and protect its users, ONEDATE has an available service which avoids the Internet drawbacks. Apart from the regular and continuous controls on the service quality; to prevent a Onedate user from suffering the attraction and fascination with the possibilities of transgression or other, the service operators strongly advised to stick to the following classic handbook :
It is a good idea to get to know each other, especially by email, before exchanging personal information (telephone number, home or office address).
We recommend you never tell anyone your home address.
Should you decide to call a person whom you met on the Web, it is a good idea to hide your caller ID on your telephone so that your number will not be seen on the receiver's telephone.

On www.ONEDATE.com site or on the application for smartphones users can create their profile by using a pseudonym (nickname). The email address that they are requested to enter will not be disclosed to other users. Any further contact will be done using internal services. The Member's identity will always remain protected, as long as the concerned member decides not to disclose it to other members.
The portal may contain fake profiles created and controlled by the website with which it is not possible to arrange real encounters. The reason for such profiles being on the portal is therefore that of entertaining the user for promotional purposes and other reasons.
Signing up to the portal is strictly reserved to adult users and completely free of charge. Members can complete their profiles during the registration steps, add photos, fill out their private areas and post a presentation. However, only "woman seeking man" users have free access to the entirety of our services. All other user types ("woman seeking woman", "man seeking woman" or "man seeking man") must subscribe to a PASS.

Members can subscribe to the subscription package most suited to their needs and buy the products currently available by credit card payment or other payment modes depending on the user's home country. The price and mode of payment for various services are available, when viewing related fees or when using the services to which the Member wishes to subscribe.
ONEDATE allows its Members to consult the files of other people who are also ONEDATE members or other sites or applications of TKD NETWORK. ONEDATE reserves the right to charge different fees or offer free access to some categories of subscribers or during particular promotions. In any case, the services price and payment methods can be viewed at ONEDATE site any time and, also while viewing and using the Services that the Member wants to subscribe for, as well as while viewing and using the corresponding fees.
Members can activate the PLUS option, during the validity period of any type of subscription, which will offer them the following additional services:
You can receive read receipts of your messages
Unlimited access to Onedate services from your mobile phone
You can surf in ONLINE/OFFLINE mode
You can decide which members can see you, when you are ONLINE
You can remove undesired profiles from your query results
You can activate an absence calendar
The PLUS option is available, upon a fee, also to members who enjoy free PASS (i.e. "woman seeking man").
Members can activate the STAR option, during the validity period of any type of subscription, which will offer them the following additional services:
You can be contacted by any member.
Your name will be on the top in the presentations given to new members/users.
Your profile will be highlighted in the Home page.
Your profile will bear the STAR member mark.
The STAR option is available, upon a fee, also to members who enjoy free PASS (i.e. "woman seeking man").
The Italian member, owner of a device running Android, may sign up to Onedate with the telephone operators TIM, Vodafone, Wind and H3G.
The price and modality of the various services are available when viewing and using the services to which the Member wishes to subscribe.
SKIB SAGL complies with the Code of Conduct for offering premium services and the protection of minors. You must be fully authorized to use the cell phone number on which you want to activate the service. If the SIM card on which you want to activate the service is not headed to the User, the User must have been authorized to activate the service by the person whose name appears on the card. SKIB SAGL expressly informs that the request for activation of the service on a numbering not headed to the User and/or owned by a person who has not granted permission to use the numbering for the activation of the service, may have consequences of civil and/or, where appropriate, criminal responsibility of the not-authorized User. The subscriber agrees to be bound by these Terms and Conditions. If you don't agree, you can not register. Registration to this service implies full acceptance of these rules by the Member.
If a Member purchases one of the subscriptions on the Internet by credit card, it will be automatically renewed for the same duration of the subscription, if there's no cancellation request from the Member, done according the procedure explained in the "Account settings"/"Account status" section - within the following deadlines:
Not later than 48 hours prior to the subscription expiry, in case of a 3/5-day subscription;
Not later than 7 days prior to the subscription expiry, in case of a monthly subscription;
Not later than 15 days prior to the subscription expiry, in case of a quarterly subscription;
Not later than 30 days prior to the subscription expiry, in case of a semestral subscription;
Not later than 60 days prior to the subscription expiry, in case of an annual subscription.
The 3/5-day subscription will be automatically renewed with the monthly package, in case there won't be a cancellation request from the subscriber within the above mentioned terms.
Nevertheless, if, for any reason, ONEDATE (in the absence of notice of the member in the terms listed below) were not able to make the renewal of one of the subscription options described, it will proceed to transact the corresponding sum to the "monthly cost" for the subscription duration.
The "monthly cost", which you can see when you select the subscription formula, is given from the total subscription amount divided by the number of months (e.g. for the 6-month subscription: it is Total subscription cost divided by 6). Therefore, the subscription will be renewed monthly.
In this specific case, the unsubscription will be done:
Not later than 7 days prior to the subscription expiry, in case of a monthly subscription
The PLUS and/or STAR option will be cancelled along with the subscription and the corresponding cancellation notice period will be applied.
If a member is enjoying PASS free of charge ("women seeking man" members only) and activated the PLUS and/or STAR option at a charge, the cancellation notice period for monthly subscriptions will be applied and the option will be renewed monthly.
Should the PLUS and/or STAR option be activated no later than the tenth day of PASS validity, its fee will be charged immediately in addition to the subscription fee. The PLUS and/or STAR option will be automatically renewed together with the subcription for the same period of validity as the subscription, unless the member cancels before the notice period corresponding to the type of subscription as stated above. In this case, the expiration date for both PLUS and/or STAR option and PASS will be calculated as of the activation date of the PLUS and/or STAR option and not from the day PASS was first activated.
In case the PLUS and/or STAR option is activated after 10 days of PASS subscription but before the last 7 days of its validity, its fee will be charged immediately for the period of the remaining months to its expiration.
If the PLUS and/or STAR option is activated during the last 7 days of PASS validity, the option will be provided free of charge for the current month (maximum 7 days) and its fee will be charged in addition to the subscription fee starting from the next renewal.
All intellectual and industrial property rights, protected based on copyright laws or other provisions concerning software, programs and computer systems regarding the Service, ONEDATE's site and/or databanks, made available to the user or member in any form or format, will continue to be the exclusive property of ONEDATE, which grants the user or member a non-exclusive, non-transferable end-user personal license in compliance with these terms and conditions.
The right to use is strictly limited to the access and to the on-line use of ONEDATE site and services for private and personal uses exclusively pertaining to and during the validity of ONEDATE membership. Any other use is prohibited.
In particular, members or users cannot edit, copy, reproduce, download, broadcast, transmit, commercially make use of and/or distribute services and content of ONEDATE site or the computer programming codes of the elements that make up the services and ONEDATE site by any means.
Every Member can resign from the contract at any time an terminate their Onedate membership without specifying the reason, by filling out the form under the Support/Contact section. The profile will be deleted within 15 days after the request has been submitted. Once the Member rescinds from the contract, Onedateshall retain any amount already paid for unused parts of membership premiums and fees, without prejudice to the provisions of art. 3, under paragraph "cancellation of automatic membership renewal"
Subject to the other provisions of these rules, in case of violation of this regulation by the Member, ONEDATE reserves the right to suspend or terminate the registration of law the contract without notice or compensation and/or bring the legal action against the same Member. This resolution will be completly, subject to the right of ONEDATE to act against the Member or his licensors to obtain compensation for any damage suffered as a result of the improper use of the service. The member will be informed by e -mail of the termination of his account. The data relating to the Member will be destroyed immediately upon its request or within the period provided by Swiss law for the storage of personal data.
The data provided by a Member to ONEDATE must be accurate and correspond to the truth. The Member is exclusively liable for the consequences to the Member's and/or other Members' lives arising from divulgating them.
ONEDATE cannot be held liable for the correctness or imprecision of the information and the content provided by Members and/or visitors of the site and/or the Member and consequences arising from them. Likewise, ONEDATE cannot be held liable for the contents divulgated by a Member that might breach the rights of one or more other Members or third parties.
Should ONEDATE be held liable for the violation of the obligations arising from the law in vigor and these Terms and Conditions by a Member, the Member shall seek to keep ONEDATE unharmed from and indemnify ONEDATE against any claim.
The Member must have the applications and make the necessary settings for ONEDATE to function correctly: browser IE6 or higher, activating JavaScript functions, receiving of session cookies and accepting to view pop-up windows.
ONEDATE does not guarantee that the services can be used if the Member uses a pop-up window blocking utility. In that case, this function will have to be deactivated before using ONEDATE. Furthermore, the Member must have the necessary competences, tools and applications to use the Internet and, if necessary, Internet and telephone services, and acknowledge the extent to which the characteristics and constraints of the Internet allow for guaranteeing the protection, availability and integrity of data transmission over the Internet. Under these terms, ONEDATE does not guarantee that the services shall function without interruptions or dysfunctions. In particular, their use can be temporarily interrupted for maintenance, update, technical improvement reasons, to change the content or their presentation. ONEDATE shall inform the Members of a maintenance or update operation in advance, as much as possible.
Due to the specificity of their Internet browsers, AOL, Safari - Mac users may have problems using the service. ONEDATE will not be liable for the dysfunctions caused by the connection via these access providers under any circumstance. Equally, ONEDATE cannot be held liable for malfunctions, impossibility to access ONEDATE or bad conditions of ONEDATE site use that could be ascribed to an inadequate tool, internal dysfunctions of the Member's access provider, the Internet traffic and any other reason that does not depend on ONEDATE.
The global responsibility of ONEDATE is limited to the amount actually paid by the Member for the service subject to a violation. ONEDATE cannot be held liable for indirect damages suffered by the Member under any circumstance, and in particular, for data loss, damages to the image, reputation, etc. (also for the copies) or registrations done by the Member, since the Member is responsible for making backup copies.
The ONEDATE site or third parties may include hyperlinks to other web sites, different from ONEDATE, or other Internet sources. Since ONEDATE cannot control these sites and external sources, it cannot be held liable for their availability or content, advertising, products and related services or any other item available on or from such sites or external sources. Any difficulty relating to a link must be submitted to the administrator or webmaster of that site. The consultation and/or use of such sites and external sources are regulated by specific conditions of use of the same. If the result of research conducted on the site onedate the Member to access sites, pages or forums whose title and/or content constitutes a violation of applicable laws, the member must interrupt consultation of the site. Otherwise the user will be responsible for his actions, since ONEDATE is excluded from the responsibilities.
These Terms and Conditions and the pages of ONEDATE site mentioned in these regulations constitute the contract that governs the relationship between the Member and ONEDATE. They annul and replace all previous provisions that have not been expressly written or attached and comprise the set of rights and obligations of ONEDATE and the Member.
ONEDATE reserves the right to change or have the ONEDATE site pages , Services, their price and applicable Terms and Conditions changed at any time. These modifications will be effective as of when they will be online on ONEDATE site, except for the right of any Member to resign from the contract in case they do not accept the changes made and cancel his/her membership with ONEDATE. In case the Member does not exercise his/her right of rescission, it is assumed that the Member has accepted these changes and continues to use ONEDATE site or its Services. Therefore, the Members are invited to consult the version which is constantly online on the site. If a Member is online and connected to the site, it means that he/she has fully accepted all the revision or amendments to these regulations.
These Terms and Conditions are governed, interpreted and applied in compliance with Swiss applicable laws. The resolution of any dispute regarding these regulations, including but not limited to, their validity, interpretation, execution and/or termination and their consequences will be remitted to the court of Lugano by unanimous agreement and unquestionably.
